Rosendo Rodriguez now claims he does not understand the nature of the charges against him, nor the terms of the plea bargain offered, and has rejected the plea bargain. He will stand trial for Capital Murder for the murder of Summer Baldwin and her unborn child sometime in the new year. No charges were filed against him in Joanna's case. The Rogers and Baldwin families, along with members of URSAR team out of Dallas, were present in the courtroom today. There should be a considerable amount of information available on the evening newscasts out of Lubbock. KCBD TV is usually pretty good - www.kcbd.com

Death penalty to be sought in Rodriguez case

Prosecutors withdrew an agreement with Rosendo Rodriguez on Wednesday morning and filed notice with the court that they would seek the death penalty.

Rodriguez, 26, is charged with capital murder in connection with the 2005 beating death of Summer Baldwin. He is also suspected in the disappearance of Lubbock teen Joanna Rogers, who vanished from her home in May of 2004.

Attorneys had hammered out an agreement months ago with Rodriguez where he admitted to killing Rogers and Baldwin, and would plead to a lesser charge of murder in exchange for a life sentence.

That agreement was supposed to be finalized Wednesday.

Jeff Blackburn, Rodriguez's defense attorney, said in court that his client refused to enter the guilty plea and now was claiming he did not understand the proceedings.

"I took this case to save this young man's life, to avoid the death penalty" Blackburn, said, calling the recent turn "bizarre."

With no word from the search of the landfill, it sounds like Rodriguez was not telling the truth about Joanna, even to save his lousy hide. He appears to be angling to appear insane.

My opinion is that justice will be served when his presence is removed.

Thank God for Texans. They'll fry (or the equivalent) his mangey a## and do the world a favor. It'll be hard for him to prove insanity to a jury if they see the videotapes of his interrogations. And Texans are not prone to letting people like him off lightly.

I'm so sorry to read about Joanna. I guess I was not expecting this outcome anyway and was hoping maybe, just maybe, she would have runaway. (Just hopeful thinking)

Any indication it was the landfill search where they found Joanna's remains?

Prayers for Joanna and her family, and the searchers who kept at it till they found her.

Yes it was the landfill search that turned up Joanna. From all information excluding the DNA and dental testing Joanna is now home. This isn't the outcome that any of us wanted but at least now, justice can be done and Jo can be laid to rest. The DA here is a good one. He takes a personal stand on the cases that he tries, and since RR has decided to play dumb, Matt Powell will not try him easy. I still have to wonder though, if RR had anything to do with Jennifer Wilkerson's disapperance. It was just 10 weeks after Jo disappeared and there are many similar circumstances in both cases. According to what I have read from Jen's family there hasn't been a link found between Jen and RR. But it still makes me wonder. Now to find Jen and bring her home to her family. In response to an earlier post about RR... I don't think that he was living here. From what I remember hearing he attended the University some years back, but was living in San Antonio with his parents. That is a good 7 hr drive from here, as I used to live there myself and still have family there. Makes one wonder how many other women has he killed? The family of Peggy Merimon (the lady missing from the Lubbock State School) thanks you for all your thoughts and prayers. She is the mother of a friend of ours.

Thanks, bodsangel. I'd have to check on the details posted here, but it was my understanding that Rodriguez had left town and fled to his parents sometime after Summer Baldwin's murder and shortly before his arrest, which led me to believe he thought he was being watched.

I also believe he is responsible for Jennifer Wilkerson's disappearance as well. I'll repost this map I made from earlier in the thread. It shows how close together these two young missing women were, and both disappeared from their homes.

That's why I think it is significant that the two young women who disappeared were store personnel on the same main drag in SE Lubbock area and lived nearby. Here's a map I made that shows this:





I think there is just no corroborating evidence tieing him to Jennifer's disappearance, such as his IM handle being found on Joanna's computer and hers on his computer in Joanna's case. The landfill likely holds Jennifer's remains as well.

Not that that's any solace to her or other missing women's families. But solace they deserve.

Yes I know how close the two young ladies were to each other in terms of location. I live in the same town. In fact the work places of both young ladies is only about 5 miles from where I live, and often in the line of work I am in, I have worked in the same area as they did. I believe that just because there hasn't been any links on Jen's computer to RR, doesn't mean that he isn't responsible. I have worked in the retail and other stores here in town and you know that you meet all sorts of different people there. And all it takes is for someone to come into your store say 3 or 4 times and order the same thing to make you feel some kind of connection. You are glad that you are able to remember either who they are or what they buy and they make you feel special cause you did so. Jen also attended one of the colleges here. As a college student at the same school she attended, I can't tell you how many different people I have met. You have anywhere from 15 to 35 students in there with you and often times for 3 or 4 hrs each class. Add that to 2-5 times a week and you feel as if you have a whole new group of friends in the matter of weeks. You start hanging out with people, inviting them over, meeting their friends, etc. All RR had to do was stop by and get some smokes a few times and carry on simple conversation (to the rest of us people) and he would have known much more about Jen than we would think. When I worked in walmart years back, I could tell you the regulars that came in to that store what they bought on most visits and more about their personal life than even their mothers knew. Jen disappeared 10 short weeks after Jo did and RR had plenty of time to get back home, act like nothing happened and come back and do it again. He got careless with Summer and that is how he got caught. I don't believe that Summer knew anything about Jo or Jen, but had it not been for RR getting careless and someone finding Summer I don't think Jo would be home yet. All the details will play out and we will know soon what exactly happened. I just wish that there was some way to get him to tell where Jen is. There is alot of open road between here and San Antonio. Lets just hope that he is the cause of it and will tell soon so that every family can have some kind of clouser. There is never really any peace when you lose a loved one, and especially to a violent crime, but at least they will be able to begin the proper grieving process.

RR - I was giving him way too much credit there at the end. I think I probably guessed more accurately at the start. He's just a big, arrogant, violent bastard who thinks the world revolves around him and that he can do anything he wants, with impunity.

Lubbock media is reporting that RR can't be charged in Joanna's murder because of the terms under which he made his confession. I don't even want to go there on that - I don't know if it's true or misreporting (that does happen, sometimes). I would dearly love to be the person who pulled the switch that opened the trap door on RR, if they still hanged murders. I would be doing the world a favor.

I hope they can trace this suitcase to him. Maybe he was stupid enough to leave the bar code on this one, too,and bought it with his debit card. Or that there's some DNA evidence (highly unlikely, I guess, after all this time) that they could pin him on. Wouldn't need the confession at that point, would they?

I think there are a few different places that the Marines can go for training. Some stay here in Lubbock, some leave. I know that some of the Navy reservists go to VA, some stay here, some Army will go to OK and some stay here as well.
I am guessing that they will have enough evidence to link RR to Jo. I just wish that there was some way to pull the deal he made concerning Jo since he backed out of Summer's. If our DA can find a way he will to get him concerning Jo as well as trying to prove he can be linked to Jen. Matt Powell is a tough DA to go against,(my sister works at the courthouse and so I have the oppertunity to know him in person as well as watch him in action against criminals.
I believe as you do Nan that they should continue to search the landfill because I can't believe that RR had no part in Jen's disappearance. I can only imagine why he was kicked out of the faternity, and I have to wonder who else he has done this to? I don't know for sure if he was living here when Jo disappeared there has been conflicting reports on where he lived, worked and when he left. So I don't know for certain if he was back here when Jen diappeared and then left again. Most training for reservists lasts about 4-6 weeks I believe. Depends on what your training is for. My nephew in the Army went to MA for 5 weeks for his latest training session.
I am glad that there will be a public memeorial for Jo. She touched many people here in town as well as all over the world. I think we all cried when the news was released. I don't think it changes much when you are on the outside looking in. (My brother-in-law was murdered by a coworker in 2000 and dumped in New Mexico. We were fortunate enough that someone saw his body on the edge of a gravel/fishing pit and reported it. That was about 3 months after he went missing.)
