Hearsay evidence proves crucial in Drew Peterson's conviction

Stacy Peterson disappeared five years ago, but the suspicions and fears she harbored about her husband haunted his murder trial and proved crucial in his conviction.

Her words came to life through two crucial witnesses who conveyed Stacy's remarks to jurors. That's hearsay evidence, or what one person tells another outside a courtroom setting.

The allowance of that evidence could possibly form the basis of an appeal by attorneys for former suburban Chicago police Sgt. Drew Peterson, 56, who was found guilty Thursday of the 2004 killing of ex-wife Kathleen Savio.

Stacy Peterson's words and her husband's conviction could also mean that he could face a new murder trial -- this time for the death of Stacy herself.

"Stacy, you are now next for justice," Savio's brother Nick Savio said after the verdict was read.

Savio was Peterson's third wife; Stacy, his fourth.

from above link

Savio was found dead in her bathtub on March 1, 2004. Her hair was wet, but the tub was clean and dry.

Drew Peterson's lawyers said her death was accidental -- that she fell, hit her head and drowned.

Savio's killing did not garner much publicity until Stacy Peterson went missing and investigators began looking again into the circumstances. They exhumed Savio's body, re-examined it and issued a second report on her death. Savio, it said, was murdered.

Peterson was arrested and charged in May 2009 with first-degree murder.

Jurors never saw any physical evidence connecting Peterson to Savio's death. Nor was there testimony placing him at the crime scene. But they heard what Stacy said.

The jury of seven men and five women deliberated for nearly 14 hours before reaching their verdict.

When the panel adjourned for the night Wednesday, the jury was 11-1 in favor of a guilty verdict, juror Ron Supalo told reporters. He was the holdout and said it was Schori and Smith's testimony about what Stacy had said that finally swayed him.

Anything to delay the sentence will be tried at this pt. Drew could face 60 years in prison. At least we know he will be off the street. Knowing Drew, he will marry in prison.

Peterson Lawyer asks that sentencing be postponed

Snip
Drew Peterson's lead attorney asked a Will County judge today to postpone the Bolingbrook police sergeant's November sentencing because squabbles among defense team members have prevented him from finishing a critical post-trial motion.

"We want to make sure we do a sufficient job," attorney Joel Brodsky said, adding recent events have been "pointing us away from what's important."

Brodsky requested that he be given until Nov. 30 to file a motion for a new trial. That would mean pushing sentencing back to mid-December or early January, he said.

Peterson faces up to 60 years in prison after being convicted of murdering his third wife, Kathleen Savio. The sentencing was originally set for Nov. 26.

The judge told Brodsky that he had already given the defense a generous extension to complete the motion. However, he will consider a request for a delay next month.

The defense has fallen behind schedule, in part, because Peterson recently fired attorney Steve Greenberg, who handled most of the team's motions. Greenberg, who had won several key arguments during the trial, was dismissed after getting into a public feud with Brodsky after the verdict.

I have not had a chance to read an article yet but found this out.

38 years in prison for the murder of a previous wife.

"I did not kill Kathleen!" Peterson shouted, leaning into a courtroom microphone and emphasizing each of the five words.

reduced to Squealing!
I bet Drew never thought he would see this day. The writing has been on the wall the whole time but he failed to see it..

Whine.

It's wonderful to know this nutjob won't be out of prison to kill again.

Rest in Peace Kathleen.

Sending out thoughts that we recover Stacy's body.

Also, I have noticed that these men, and now women, (Jodi Arias) seem to think anyone will be moved by their tears..

I wonder how many women are still lined up to date Drew? I hope this sentence will sink in to them and they will lvie their llves.

Former police Sgt. Drew Peterson gets 38 years for ex-wife's murder
By Greg Botelho, CNN

Snip

After years policing Illinois streets for criminals, Drew Peterson is now among them -- and will be for more than three decades, a judge ruled Thursday.

Will County Judge Edward Burmila sentenced Peterson to 38 years in prison in the murder of his third ex-wife, Kathleen Savio, said state's attorney spokesman Charles B. Pelkie.

The former Chicago-area police sergeant will get credit for the nearly four years that he has been in custody, according to Pelkie, a spokesman for Will County State's Attorney James Glasgow. He could have received as many as 60 years in prison; Illinois does not have a death penalty.

Several Savio family members specifically mentioned Stacy when they addressed reporters late Thursday afternoon in Joliet.

Henry Savio Jr., a brother of Kathleen Savio, said Stacy Peterson's relatives "deserve the same thing that we're getting right now: justice."

As to Peterson's fate, Henry Savio said he wanted him to "stay in jail forever, to die there."

"(Then) he is going to go to hell," the victim's brother said. "And my sister is going to be watching him."

It appears that Peterson will not live to see the light of day outside the prison walls, good on him, no offence but he has murdered two women that we know of; and likely hurt more people in his job as cop. Seems he likely did not get charged earlier as his fellow officers believed the scum ball or hid evidence, or did not seek evidence...there should be an investigation into the police who investigated this case initially.
