I wonder why this letter was never admitted into evidence? Does anyone think that keeping evidence from the defense earlier on is now biting the prosecution in the butt?

I'm confused.

If the letter was not made available for the defense to peruse or for that matter to use as a means to discredit Morales (depending on the content), then why did the prosecution mention or allude to the contents during the trial? Doesn't that 'open the door' for the defense?

This trial is a mis-trial, out of the gate IMO.

The defense has been complaining from the get-go about the behaviour of the prosecution.

Just sent him an email- the Levy family has a son as well and he stated that their only child was Chandra...

That has me most intrigued. If the jury is savvy enough to request a photo of Guandique that they somehow know has been submitted as evidence but weren't shown, and they have determined to ascertain whether this is a photo around May 1, 2001 of Guandique and whether there are these significant facial injuries testified to by the landlady, then this is indeed a worthy jury for this trial.

I asked the question in Murder on a Horse Trail, and no one would try to answer it except a jury. That sums up the state of the investigation into Chandra Levy's disappearance to a T.

This is a good point and I know jane was only speculating that that might be the photo, the May 7 mug shot of his arrest.

However, no one has ever indicated they've seen it and unknown that it exists. My guess was that the DC police would have destroyed it as counterproductive to the agenda.

It may very well be a photo of tattoos. That prosecution would be submitting, I would be stunned and amazed if they submitted a mug shot that showed one of their star witnesses lying.

PS. I see in earlier post that it is a photo of Guandique taken in Rock Creek Park. A personal photo they obtained, perhaps from girlfriend?

I'll best it still has to do with tattoos. They want to see what kind of tattooed gangbanger he was before he went to prison as DC prosecutors claim.

Arrest report said no visible tattoos.

Good point about the jury wanting to see the photo of Guandique- being a good sign. Totally agree. Hopefully it is the 1st arrest photo that Rainbow mentions?

Attorneys argue over letter as Levy jurors deliberate

During closing arguments Tuesday, Guandique's lead attorney, Santha Sonenberg, told the jury that Morales was "coached" by the prosecution and suggested that information in Morales's letter differed from his testimony as a result of that coaching. Sonenberg repeatedly suggested that if jurors wondered why the letter was not introduced as evidence, they should look to prosecutors for answers.

Prosecutors were outraged by the accusations. Campoamor aggressively tried to get the letter in front of the jurors to rebut Sonenberg's assertions.

Campoamor told Judge Gerald I. Fisher that Sonenberg was "attacking the government" and that if the letter is not admitted, "we can't prove what was in the letter."

"Jurors won't be able to assess whether to believe her argument that important details were missing or that Mr. Morales was coached by us," Campoamor said. "We are hampered in our ability to counteract efforts by the defense about [Morales] being coached if the jury doesn't have the letter and evaluate for themselves," Campoamor argued.

Fisher rejected Campoamor's request, ruling that the letter should have been admitted during the trial, not during deliberations.

Unfortunately my guess was wrong - see earlier in this thread I post that Mike Doyle said the photo was of Guandique in Rock Creek Park.

And, as rd has stated, this must be a photo that could be used to discern visible tatoos.
