Diaz says in the page Rainbow mentions above
Quote:
I write in detail in my book on MS-13 and other transnational Latino gangs (18th Street and Latin Kings in particular) about three particularly brutal murders in Texas and Virginia committed by MS-13 gangsters. All of them involved remorseless hacking with knives.
There would likely be multiple knife-marks on the skeleton in such cases, whereas the absence of such was noted in Chandra's autopsy.

OK - now I have finished reading Diaz' article. He expresses quite a bit of sympathy for Condit. Diaz has confidence in the willingness of the justice system to search out the truth. If only.

Hi Jane and all!
Great comment, Jane. Are "knives' connected with the "Chucky" story in any way? The "prosecutorial" media keeps underscoring the "Chucky" theme. Could there be some markings on the bones, where they were "detached" from the body by a power-saw or something else that is sharp like a knife, sometime before concealment?

Hi Rainbow! Well, in the Warrant it says about the bones
Quote:
....(2) they had no evidence of nicks; and (3) they had evidence of animal activity....
so it doesn't seem the prosecution is planning to claim that any hacking with a knife took place. Unless they are deliberately trying to confuse the defense. Could the prosecution be planning to call an expert witness to state some marks previously thought to be from animals could be just as plausibly interpreted as knife marks...

Also, more importantly, no blood stains found on the clothing remnants. That in conjunction with no knife marks on the bones clearly established that Chandra was not stabbed and led to no conclusive cause of death.

This directly refutes the story of the first "cellmate confession", who is a listed witness, who also failed his lie detector test while Guandique passed his, DC police and Washington Post brainwashing of a rewritten history notwithstanding.

It also refutes the gist of the second cellmate confession, that of a brutal MS-13 gang murder supposedly taking place. The writer Diaz describes in some detail the stabbing rituals of these murders. Clearly the second cellmate confession is just as made up as the first one. Made up for the purpose of early release if they play ball with the DC police and lie to them and a jury.

Some justice system. I don't know which side of the ball is more corrupt.

Hi rd. Because prosecutors are more phony than convict-witnesses, in a way the prosecutors are more corrupt than the cons. We anticipate that convicts will lie, but we expect honesty from prosecutors. They are supposed to be, and pretend to be, above lying in court. Or to knowingly allow and encourage their witnesses to lie in court, which amounts to the same thing as lying themselves.

That's my take on it, too, jane.

You would hope to expect more from prosecutors and police than from the lowest of the low life forms we have locked up looking for ways to get out and create more victims.

But as I wrote in Murder on a Horse Trail, when all else fails, this is what prosecutors and police trot out. It's quite predictable, just as predictable as the behavior of the prison predators they use in this symbiotic relationship.

I found this story on WTOP.com. If the prosecution of Guandique falls through, maybe they can blame Chandra's murder on this guy?

Police step up Rock Creek patrols after sexual assault
July 23, 2009 - 9:26am

WASHINGTON - U.S. Park Police are stepping up patrols in Rock Creek Park after a man sexually attacked a woman who was jogging.
The assault occurred around 7 a.m. Wednesday on a running path near the Milkhouse Ford area, south of Bingham Drive and north of Joyce Road.

U.S. Park Police say a Hispanic man grabbed the woman, pulled her into the woods and sexually assaulted her.

The suspect is described as in his 30s, between 5-foot-7 and 5-foot-10, with a stocky build and wavy, black, shoulder-length hair.

He was unshaven, smelled of alcohol and was seen talking to himself before the attack.

Police say he was wearing a cotton T-shirt and jeans.

"With that good description that we have, we think that we have a good chance of being able to develop a suspect from this," Park Police Sgt. David Schlosser said.

Rock Creek Park has been no stranger to criminal activity.

In 2001, Chandra Levy disappeared while jogging there. Her remains were found the park a year later.

Ingmar Guandique, who has been charged in Levy's death, has been serving a 10-year sentence for two other attacks in the same park.

yeah, I saw that James. This falls into that broad vague category of "jogging in Rock Creek Park". People need to see for themselves the difference between the Millkhouse Ford area or Beach Drive where Guandique attacked joggers and Ridge Road where Chandra was found down the side of a steep hill.

People should also note that none of these jogger attacks has resulted in a murder as is alleged in Chandra's case, two of which are included in Guandique's three encounters with women six days, two weeks, and six weeks after Chandra's disappearance. Guandique fled in all these attacks, albeit leavng the women terrified.

Yet six days and two weeks and six weeks earlier, the prosecution contends that this same person who fled encounters over and over in ensuing days is the person responsible for Chandra being found on the side of a cliff hundreds of feet above Broad Branch Creek tied up with her own leggings and murdered.

The prosecution and police sincerely do not want anyone to understand what they contend, otherwise they would be seen as fools. But understand people will as we go through that trial.

People will understand that Chandra didn't jog, didn't go deep into a national forest in the middle of nowhere "because it was a nice day", and that anyone who has a lick of sense who visits the site will see that the only way for her to be up there was to be dumped from a car, dragged out behind a picnic bench and down that steep cliff and hidden.

Only one person had the means and motive to do that, and that was Congressman Gary Condit.

Here's some excerpts of the story from the Washington Post. This is the first I've heard that Guandique killed his two accomplices in the Levy murder. Is that new? And shot a bystander! How can anyone possibly buy this?

Prosecutors in Levy Case Tell Court of New Witness

By Keith L. Alexander
Washington Post Staff Writer
Friday, July 31, 2009

Prosecutors say they have identified a new witness who claims to have been attacked on a jogging trail and stabbed by a man matching the description of Ingmar Guandique, the suspect in the Chandra Levy slaying.

In an evidentiary notice filing with D.C. Superior Court late Thursday, prosecutors involved in the Levy case alerted Guandique's attorneys that they plan to call the witness to testify. Guandique has a hearing scheduled Friday.

According to the documents, the newest witness identified Guandique as the man who ran up from behind the witness on a jogging trail, pushed the person to the ground, then stabbed the witness in the back. The witness, fearing a robbery, told the attacker that he or she did not have any money. The document had no identifying information on the witness or the location of the attack.

The documents were filed by Channing Phillips, acting U.S. attorney for the District, and Assistant U.S. Attorney Amanda Haines, one of the lead prosecutors in the case.

Prosecutors also provided an updated list of evidence that they say links Guandique to Levy's killing, including alleged confessions to other individuals that he and two other members of the MS-13 gang killed Levy in Rock Creek Park. Guandique said he later killed the two gang members.

Guandique also allegedly told individuals that he shot a bystander who attempted to intervene during the Levy attack.

(snip)

In the filing, prosecutors said they plan to identify witnesses who allegedly spoke with Guandique about using drugs and alcohol before his attacks. Guandique also allegedly sodomized one of his cellmates.

Guandique's defense attorneys argued that much of the witness testimony came from other prison inmates who were looking to strike deals with the prosecution.

Also in the filing was a letter to Guandique's attorneys reminding them of the plea agreement that they offered, which expired July 24.

(snip)

Prosecutors also said that the FBI had tested DNA found on Levy's tights but that there was no DNA match to Guandique.

In addition to the witness who was stabbed by a man fitting Guandique's description, prosecutors said they identified six other witnesses who were either attacked by Guandique or who had conversations with him in which he allegedly bragged about his prior attacks.

At his most recent hearing in May, Judge Geoffrey M. Alprin set a trial date of Jan. 27 against the objections of Guandique's attorneys, who argued that the date was too soon.

This is getting more and more ridiculous.

Before we heard about a knife, but now we are hearing about a gun.

Prior to his imprisonment, Guandique had no gang tattoos, so it appears if he became a member of the MS-13 gang it must have been while in prison. But now the prosecution is saying Guandique killed two members after they helped him kidnap and murder Chandra? And then he became part of the gang?

Guandique shot someone who tried to intervene in the crime against Chandra? Well, did that person die? If so, has his corpse been found? If he recovered from a gunshot wound, where is he now?

These stories do not hang together at all.

The prosecution is basing their case mostly on the testimony of convicts and hearsay about unidentified, dead witnesses.

Thanks for the updates, everybody! The prosecution's case seems more and more "in-/un- credible" as time goes by. Wasn't Ms. Sonnenberg supposed to get the discovery she asked for by the end of this month? Has anyone heard anything about that?

This is getting ridiculous. If Guandique said that he he abducted Chandra in a flying saucer and took her to Mars, would they introduce that as evidence against him too? They say that Guandique shot someone while abducting Chandra, and then just leave that hanging out there, with absolutely nothing else to say about it, or to back it up?

This is starting to look more and more like a John Mark Karr situation. They mentioned that the deadline for Guandique to agree to a plea bargain passed July 24. The DC prosecutors bluff has failed. They had better drop this thing now, before they end up looking any more foolish than they already do.

Hi everyone! Does anyone know what the defense can do next - can they move to have the case dropped?

Does Guandique have the right to demand a trial at this point, even if the prosecution decides they do not want to go forward with the case? A trial could be extremely interesting! I wonder how many witnesses would take the 5th (such as the congressman Chandra had been living with/dating in the months before her disappearance...)
