Accused kidnapper indicted on federal child porn charges

(CNN) -- Michael Devlin, accused of abducting two Missouri boys and holding one for four years, has been indicted in federal court on child pornography charges, a federal prosecutor said Thursday.

U.S. Attorney Catherine L. Hanaway announced the charges -- four counts of child pornography and two counts of transporting a minor across state lines to engage in illegal sexual activity.

The charges relate to the boy that was held for four years. Both boys were freed on January 12.

The parents of 15-year-old Shawn Hornbeck, whom Devlin is accused of abducting in 2002, told Oprah Winfrey in a show that aired in January that they suspect their son was sexually assaulted by Devlin.

Hanaway said Devlin, a former pizzeria manager, faces up to 170 years in prison on the six charges.

Devlin, 41, has already pleaded not guilty to charges in Franklin and Washington counties that he kidnapped a 13-year-old boy in January and an 11-year-old boy in 2002. He faces life in prison on those charges.

He has also been charged in St. Louis County with 71 related counts. The first 18 counts -- one count of kidnapping and 17 of forcible sodomy -- relate to the abduction of Ben Ownby, 13.

The remaining counts are kidnapping and forcible sodomy charges related to the 2002 abduction of Shawn Hornbeck.

Those charges also carry life sentences.

The new charges allege that Devlin produced Polaroid photographs and videos of Hornbeck and took him to Illinois and Arizona.

"I'm sickened by it," Hanaway said. "This minor, over the course of five years, had child pornography produced with them as the victim, and was taken across state lines so that illegal sex acts could be committed."

The two boys were discovered January 12 in Devlin's Kirkwood, Missouri, apartment after officers questioning him about his truck -- which matched the description of a vehicle seen on Ben Ownby's street when he was abducted -- became suspicious about his demeanor. (Read full story)

Typically, CNN does not identify alleged victims in sexual assault cases but has decided to do so in these cases, given the publicity their cases have already received.

Devlin is being held in Franklin on $1 million bail.

(AP) UNION, Mo. Federal and local prosecutors are considering a plea deal that would mean life in prison for a man accused of kidnapping two boys and sexually abusing one of them, a prosecutor said Tuesday.

Franklin County prosecutor Robert Parks said he may join with prosecutors from the federal government and Washington and St. Louis counties in offering a plea deal to Michael Devlin, 41.

It would include "several, several consecutive life sentences," Parks said. He wasn't certain when the deal would be offered.

Devlin, a former pizzeria manager, pleaded not guilty Tuesday to charges of kidnapping and armed criminal action for the Jan. 8 abduction of 13-year-old Ben Ownby.

He also is accused in Washington County of the 2002 abduction of 11-year-old Shawn Hornbeck. Both boys were found Jan. 12 at Devlin's apartment in the St. Louis suburb of Kirkwood. In St. Louis County, Devlin is charged with forcible sodomy, and in federal court, he is charged with producing child pornography.

The federal charges also accused Devlin of taking a minor across state lines and sexually assaulting him. He has pleaded not guilty to all of the state charges but has not entered a plea in the federal case.

Devlin's attorney, Michael Kielty, would not comment on a possible deal until he sees prosecutors' evidence in the case.

"We will prepare as if we will go to trial," he said.

Devlin remains at the Franklin County jail on $1 million bond.

A Franklin County judge set a hearing for May 15 to determine if the case there is ready to go to trial.

While it is The Associated Press' policy not to identify alleged victims of sexual abuse in most cases, the boys' stories have been widely publicized and their names are now well-known. Their families also have gone public, conducting media interviews.

Michael Devlin Turns Down Plea Deal


A Missouri man accused of kidnapping and assaulting two boys, who were found in his apartment, has turned down a plea agreement that would have sentenced him to prison for life. Michael Devlin's attorney said the offer was not a "deal" at all and his client could do better going to trial.

Devlin is facing six federal charges and 75 state counts involving kidnapping, sexual assault and child pornography in connection with the abduction of Shawn Hornbeck and Ben Ownby. Earlier this week, prosecutors said they were offering Devlin a plea deal that would include him being sentenced to several consecutive life sentences.

Devlin attorney Ethan Corlija told reporters that the "deal" would basically amount to the maximum sentence Devlin would face if he was convicted at trial on every charge.

"Let's see what 12 people can decide. Because I think we can do far better with a jury," he said. "You've heard one side of a story. That's it. At trial, both sides are going to come out."

However, one prosecutor said his goal was to see that Devlin was never released from prison. "I cannot see any plea agreement that would not include consecutive life sentences, because, what good would that do?" said Franklin County Prosecuting Attorney Robert Parks.

I doubt Devlin has a better chance at trial, but he is stupid enough to think so and so is his attys.
