Just think how much injustice there must be in supposedly enlightened places such as the U.S. and Canada, let alone other parts of the world. The only reason we know how wrong this verdict is, and the shenanigans that went before it, is that we were incredibly focused on this case and the media were putting material out there for us to scrutinize. I imagine this piece of injustice is merely the tip of the iceberg.

Yes, this was a very eye-opening experience. Like I have said before. I used to live in another country (Germany). One of the cities I lived in during the Cold War was Berlin. It was common knowledge even in a highly-cultured country, like Germany, that if young women like Chandra Levy or Joyce Chiang were killed under similar circumstances, it was because of their close association to politics and/or politicians.

Wasn't that one of the reasons that Monica Lewinsky hired Abbe Lowell and Anne-Marie Smith hired Jim Robinson and went public, as well?

My impression was that Monica Lewinsky went public because of that woman she confided in (who seemed to be connected to people who wanted to topple Clinton). But I have heard commentators say that it was safer for Monica Lewinsky that she went public. Remember, she was being protected - well, practically imprisoned, but it may have been the safest thing for her - by Clinton's enemies?

It's interesting that Mr. C. retained Abbe Lowell to represent him.

Is Abbe Lowell the go-to guy for the Democrats, do you think?

I originally thought that Mr. Lowell was retained by Mr. C. because of the "reverse similarities" between the Lewinsky and Levy cases, as when an attorney (e.g. Johnny Cochran, Billy Martin) who is a great prosecutor, then makes a great defense attorney, because he/she knows how the prosecution operates and/or has familiarity with the type of case from the opponent's perspective.

Here is an excerpt from the bio that Mr. Lowell has posted on the McDermott, Will and Emery LLP website:
http://www.mwe.com/index.cfm/fuseaction/bios.detail/object_id/4f563be6-81da-40cc-ad34-831caffa49ec.cfm

Abbe David Lowell is a partner in the law firm of McDermott Will & Emery LLP based in the Firm’s Washington, D.C., office. He is head of the Firm’s White-Collar Criminal Defense group in Washington, D.C.

Abbe’s practice focuses on litigation, special investigations and regulatory enforcement. He has represented numerous high-profile clients and provided counsel in matters of national and international importance. Abbe has successfully tried numerous complex cases, both civil and criminal, throughout the United States, and he has briefed and argued dozens of appeals before federal and state appeals courts and before the Supreme Court of the United States.

In addition to trying cases and arguing appeals, Abbe advises clients in their dealings with U.S. Congress and its committees, other legislative bodies and numerous federal and state regulatory agencies. He also works with clients on internal investigations, voluntary disclosure decisions and developing compliance programs to prevent issues from arising with agencies.

In criminal matters, Abbe has successfully avoided charges or defended clients against a wide array of charges, including conspiracy, election law violations, bank fraud, insurance fraud, bankruptcy fraud, mail and wire fraud, securities fraud, money laundering, public corruption, honest services fraud, false claims act, false information charges, and violations of the Racketeer Influenced and Corrupt Organizations Act (RICO). In civil cases, he has helped clients defeat claims of breach of contract and fiduciary duty, civil rights violations, conspiracy, employment discrimination, negligence, RICO violations, securities fraud, tortious interference with business and unfair trade practices.

Prior to joining McDermott, Abbe was a partner in the Washington, D.C., and New York offices of a prominent international law firm. From 1983 to 1999, he was founding and managing partner at Brand & Lowell in Washington, D.C.

Abbe has been counsel to the U.S. House of Representatives twice, most recently when he was Chief Minority Counsel during impeachment proceedings against President Clinton and before that as special ethics counsel to the House Committee of Standards of Official Conduct (Ethics Committee).

From 1994 to 1996, Abbe was appointed as Special Counselor to the United Nations High Commissioner for Human Rights in the investigation and prosecution of human rights violations, war crimes and other human rights projects in Rwanda and the former Yugoslavia.

Abbe has also served at the U.S. Department of Justice from 1977 to 1981 as a Special Assistant U.S. Attorney, Special Assistant to the Deputy Attorney General and Special Assistant to the Attorney General.

His high-profile clients have included public officials (Governor Jim Gibbons, Senator Robert Torricelli, Reps. Gary Condit, Charlie Wilson, Walter Fauntroy, Harold Ford, Bill Boner, Jim Weaver, Austin Murphy, Joe McDade. N.Y. Majority Leader Joe Bruno and others), international organizations (U.N. High Commissioner for Human Rights), state and local governments (City of Alexandria, Virginia), government lobbyists (Jack Abramoff; AIPAC lobbyist Steve Rosen), businessmen (Gene Phillips and Sam Waksal), actors (Steven Seagal, Sean Combs) and others.

Abbe’s writings on legal issues and current political events have been widely published. He has written op-ed pieces for newspapers, including The Wall Street Journal, The New York Times, The Washington Post, USA Today and Roll Call as well as articles for legal publications and websites, such as Business Crimes Bulletin, American Criminal Law Review, Law.com, The National Law Journal and Legal Times. He wrote the chapter, “The Penal System Is Broken” for Beyond a Reasonable Doubt, a book edited by Larry King.

Quote:
Regarding the Condit lie detector test, here's some other morsels to keep in mind.
In his post tonight Mickey Kaus notes that Aldrich Ames, the notorious CIA spy, passed a number of lie detector tests. So clearly the technology is not infallible.
But this only scratches the surface of the story.
The polygraph expert retained by Condit attorney Abbe Lowell is named Barry Colvert, a former FBI lie detector expert. One of the bullet points on Colvert's resume is that he did the interrogations of Aldrich Ames. Now I don't know if the tests Ames beat were administered by Colvert. But it seems like a definite possibility. So it's not just that Ames beat a lie detector test. It may be that he beat this expert. But there's more. A lot more.
Back in January 1998 when former Teamsters' President Ron Carey was trying to fight off an indictment and expulsion from the union over the campaign donation-swapping scandal, he decided to take a lie detector test to clear himself. He passed the test.
The test was administered by none other than Barry Colvert.
Now this is a little painful for me to say, because I always liked Ron Carey, but the bottom line is that he was eventually indicted. So Colvert's results look a little iffy in retrospect.
More striking though is the way that test was apparently administered. Read this snippet from a January 21st, 1998 AP story and see if the Carey test doesn't sound very similar to the one Abbe Lowell described Colvert administering to Gary Condit.Barry Colvert, an agent for 35 years who interrogated Aldrich Ames and other high-profile spies, asked Carey two crucial questions about the scheme.
"I did not find any indication of deception in either of those primary questions," Colvert said. He added that, "If the readings were close and flat, I wouldn't have rendered that opinion."
Colvert's questions and the questions posed to Carey by his attorney, Reid Weingarten, were limited to charges that about $735,000 was donated by the Teamsters to generate contributions to Carey's re-election campaign.
Carey was not asked if he knew that other labor leaders, including AFL-CIO Secretary-Treasurer Rich Trumka, allegedly had funneled prohibited donations to his campaign.
Sounds similar, doesn't it? Highly restricted questioning ... "two crucial questions" ... "the primary questions" etc. And apparently no follow-ups on the factual nitty-gritty of the case.(Carey seems to be the only other high-profile case Colvert has handled since he went into private practice in 1997 -- I base this on a Nexis search on Colvert's name which revealed no mentions beside those tied to Carey.)
And then there's one more detail.
My understanding is that, at approximately this time, Carey had working for him a PR consultant by the name of Marina Ein. (I do not know whether she was still working for Carey at the time of the test in January 1998 -- but I know she was shortly before that.) And as you'll remember, if you're following the case, that's the same Marina Ein who is now working for Gary Condit. What does this all mean? I'm going to let the information speak for itself. But it does make you wonder.

One of the programs Academy Group, Inc., provides:

Cold Case Analysis Program™ (CCAP)

http://academy-group.com/cold_case.html

Quote:
The Academy Group, Inc., salutes the innovative efforts of law enforcement in its struggle to bring to justice violent criminals who have successfully avoided detection, apprehension, and prosecution. Our Cold Case Analysis Program™ (CCAP) is designed to assist in that endeavor by making available the unique experience of the pioneering research undertaken by the FBI and the Behavioral Science Unit at the FBI Academy.

CCAP™ practitioners will independently review and analyze the original crime and investigate to determine case solvability through the maximum application of all available resources and knowledge. The CCAP™ process can identify investigative shortcuts and may detect new offender vulnerabilities.

Most cold case reinvestigations benefit from the application of Criminal Investigative Analysis, which includes the development of an offender's criminal profile. AGI practitioners formulated the FBI's profiling and crime analysis techniques and have guided its successful application time and again.

CCAP™ services may aid investigations by:

Evaluating a case for solvability potential
Case organization or reorganization for maximum efficiency
Development of a phased investigative action plan
Crime Analysis:

Development of offender's motivation
Crime scene or crime scenario reconstruction
Analysis of significance of events that occurred during crime
Offender profile development
Post-offense behavioral issues

Search warrant assistance
Witness and offender - Interview or interrogation planning
Interview and interrogation tactics and strategies for targeted individuals:

Indirect assessment
Timing and sequencing of interviews
Utilization of props

Designing appropriate media strategy to facilitate investigative efforts
Planning a covert investigative phase, if applicable
Prosecutor and prosecutive strategies
Expert testimony

I see in news today that Amanda Knox is appealing, and in a court appearance told the court "you have made an enormous mistake."

http://www.foxnews.com/world/2010/12/11/knox-makes-emotional-address-italy-appeal/

"I am innocent. Raffaele is innocent. We did not kill Meredith," Knox said during her 20-minute address, speaking Italian, and her voice breaking. "It doesn't' do justice to Meredith and her loved ones to take our lives from us."

Knox had addressed the court in the previous trial but never for as long or as passionately. She said she regretted not being able to fully speak her mind before, saying that words don't come easily to her and that she has a difficult time standing up for herself.

In the United States, the coverage of the case has been largely favorable to the American and critical of the Italian handling of the case. Some raised doubts over the investigation and the collecting of forensic evidence allegedly linking Knox and Sollecito to the crime.

At the appeals trial, the defense lawyers for Knox and Sollecito are seeking a full review on the forensic evidence, including disputed DNA evidence that was found on a knife allegedly used in the murder and on the clasp of Kercher's bra.

The defense maintains the DNA traces were inconclusive, and asserted that they may have been contaminated when they were analyzed. They also want new testimony to be heard.

end quote

This is precisely what should happen for Guandique. It should have happened in the trial, and an appeal three years later as Amanda must do should be unacceptable.

Guandique and his defense lawyers should lay the same out to the courts and American people in an appeal hearing.

An enormous mistake has been made in letting the US government crush an illegal immigrant for a Washington intern's political murder.

Jury convicts man in killing of Chandra Levy in 2001

Let's hope for the family of Chandra Levy that justice was done by convicting Ingmar Guandique of the 2001 murder of Chandra Levy. But reading the news stories surrounding the conviction makes me pause. I have spent quite a bit of time studying wrongful convictions, as well as talking to those exonerees who spent time in prison, some on death row, for crimes they did not commit. This case looks dubious.

Here are some suggestions by Pat Brown on how she feels "outrage about the Guandique verdict" should be displayed.

I think the the outrage has to be combination of family, victims' organizations, legal associations, media, and citizens who speak out against outrageous prosecutorial and jury decisions. We need to be outspoken about people being convicted without reasonable evidence and about killers being left in society because the wrong person is in prison. We need to question a system that allows this kind of nonsense.

Why a Republican is safe as D.C.’s top lawman
By: Harry Jaffe
Examiner Columnist
March 4, 2009

U.S. Attorney Jeffrey Taylor, left, announces developments in the Chandra Levy case in Washington on Tuesday. (Andrew Harnik)
The authorities summoned the media Tuesday afternoon to announce they had gathered enough evidence to charge Ingmar Guandique with killing Chandra Levy in May 2001. Reporters packed the room to take in the latest chapter in a sexed-up crime thriller that had occasionally consumed the airwaves for nearly a decade.

First, Mayor Adrian Fenty stepped to the microphone and broke the news. Then Police Chief Cathy Lanier talked about how important it was to resolve the case for the Levy family. Then U.S. Attorney Jeffrey Taylor got to the meat of the matter and unveiled the new evidence.

Taylor sits atop the law enforcement pyramid in the nation’s capital. He decides which cases to prosecute; he directs prosecutors and deploys federal and local lawmen, all of which makes him more powerful than Lanier. It was Taylor’s prosecutor, Assistant U.S. attorney Amanda Haines, who had pursued leads in the case and managed the assorted lawmen.

The question for more than a few watching Taylor take the stage was: What is he still doing there? Why is a Republican appointee of George Bush, who worked for John Ashcroft and Alberto Gonzalez, still United States Attorney in a Democratic city?

THE ASSOCIATED PRESS. "Gary Condit testifies in Levy murder trial." Charleston Daily Mail. Charleston Newspapers. 2010. HighBeam Research. 23 Dec. 2010: http://www.highbeam.com/doc/1P2-26116615.html

Then-U.S. Attorney Jeffrey Taylor has acknowledged the case lacked DNA or physical evidence linking Guandique to Levy. And Guandique never confessed to police - in fact, he passed a lie- detector test denying involvement in Levy's disappearance, though prosecutors now question the validity of that test.

But Taylor cited significant circumstantial evidence, including numerous confessions that Guandique purportedly made to other inmates. And Levy's body was found in a wooded section of the city's Rock Creek Park, where Guandique was convicted of assaulting two other young women in 2001.

The FBI framed the "amthrax" killer. Is Chandra Levy's "killer" going through the same?

If my smeller is right--that Levy's death was a political murder--then the reason for this clean-up operation (as the mafia would put it) is that there is someone who knows something, maybe someone in a position to come forth now that Cheney has been ousted from direct power over our agencies.

The initial investigation was seriously botched. And one of the ways it was botched was that neither the FBI nor the DC police ever questioned Dick Cheney or his aides about the meeting he had with Gary Condit on the very day that Chandra Levy disappeared, and during her very disappearance hours. (12:00 noon, May 1, 2001.) The DC media were also completely uninterested in this meeting and never asked questions about it. Two days later, on May 3, Condit was one of only 10 Democrats who voted for Bush/Cheney's first tax cut for the rich, in a very controversial, close vote.
