Jurors view spot where homeless man was killed

    JOHN C. ENSSLIN
    THE GAZETTE

Criminal trials don’t often convene in public parks. Today was the exception.

Jurors in the first-degree murder trial of Taylor Lane Gwaltney travelled by shuttle bus shortly after 9 a.m. to Monument Valley Park where they made a brief inspection of the crime scene.

One by one – including one juror in a wheelchair – they filed across the pedestrian bridge that spans Interstate 25, pausing at the spot on the eastern side of the bridge where David Doyle was found dead on the morning of Feb. 5, 2009....

....Normally, judges advise jurors to avoid visiting crime scenes during a trial. But in this case, 4th Judicial District Judge G. David Miller agreed it would be useful for jurors to view the location. No testimony was given. Jurors walked silently across the bridge while the judge and the lawyers trailed behind them.

Such field trips are rare, but they do happen. In April 2009, jurors in the first-degree murder trial of Salvator Esquivel-Castillo visited a site southeast of Marksheffel Road where the body of Jaclyn Funderberg was found at the base of a cliff....

Excellent info, jane. Thanks.

If ever a trip to an alleged crime scene was called for, it is Chandra on this "jogging trail". No one even cares how she got there from her apartment on Dupont Circle.

But the jurors need to walk back there on the No Horses path above where Chandra was found, the more adventurous down to where her body was hidden.

This is just sad that we have to discuss such a fundamental requirement to determine the truth.

It is excellent information- thanks Jane.

Jon Ensslin, Legal Affairs reporter for The Gazette states that the Judge in the case of David Doyle, the homeless man- murdered on a bridge in
Monument Valley Park, initiated the field trip to the crime scene.
