(CNN) -- The suspect in the death of a 20-year-old pregnant Marine will be returned to North Carolina to face charges in her slaying, a Mexican judge ruled Thursday, according to North Carolina authorities.

U.S. Marine Cpl. Cesar Laurean was arrested in Mexico in April.

1 of 2 U.S. Marine Cpl. Cesar Laurean, 21, who was arrested in Mexico in April, could be returned to Onslow County, North Carolina, within a week, the county sheriff's office said in a statement issued Thursday. Federal authorities will handle his transportation to the North Carolina jail.

Laurean has been indicted on first-degree murder and other charges in the death of Marine Lance Cpl. Maria Lauterbach. Her charred body and that of her fetus were found beneath a fire pit in Laurean's backyard near Camp Lejeune, where both were stationed, in January, a month after she was last seen.

Prosecutors allege that Laurean killed Lauterbach on December 14 and used her ATM card 10 days later before fleeing to Mexico to avoid prosecution.

Laurean was arrested in April in San Juan Vina, in the Mexican state of Michoacan. Because he holds citizenship in the United States and Mexico, he could not be immediately deported and had to go through the extradition process, authorities said.

This just burns me up!!!

JACKSONVILLE, N.C. — The attorney for a Marine accused of killing a pregnant colleague says his client is fighting extradition to the United States.

Dick McNeil says 21-year-old Cpl. Cesar Laurean has filed an extradition appeal in a Mexican court.

In September, North Carolina officials said a Mexican court approved returning Laurean to the U.S.

Laurean is charged with first-degree murder in the slaying of Marine Lance Cpl. Maria Lauterbach. The 20-year-old from Vandalia, Ohio, was eight months pregnant when she was killed late last year.

Marine Accused of Killing Pregnant Colleague Extradited to United States
Friday, April 17, 2009
Associated Press at Fox News

SNIP

Cpl. Cesar Laurean, 22, was extradited to face a murder charge in the death of Lance Cpl. Maria Lauterbach, 20, of Vandalia, Ohio, said FBI spokeswoman Amy Thoreson.

Onslow County District Attorney Dewey Hudson said he expected Laurean to arrive at the local jail Friday night and appear in court Monday morning.

Thoreson said she wasn't sure where Laurean entered the United States because several agencies were involved and plans changed several times during the day.

"He's back in the United States," Thoreson said. "Our goal is to get him all the way back to Onslow County to local authorities."

Someone arrested on a felony charge must have a first-appearance hearing within 96 hours, Hudson said.

Laurean was charged with first-degree murder in January 2008, after Lauterbach's charred remains were found buried in his backyard in Jacksonville. She was eight months pregnant.

This tops it all- it wasn't even his baby and they thought it was all along. So he killed her and thought he was killing his own baby. What a sin.
I hope they throw the key away on this guy.

Marine Not Father of Lauterbach's Child

SNIP

A former Marine who has been charged with the murder of a pregnant colleague was not the father of her unborn child, according to DNA tests conducted by military investigators. DNA showed that Cpl. Cesar Laurean was not the father of Lance Cpl. Maria Lauterbach's unborn child.
Lautherbach was eight months pregnant when she was killed December 2007.

The DNA testing was conducted by the Defense Armed Forces Institute of Pathology. They compared bone samples from Lauterbach's autopsy to DNA samples collected from Laurean after he was returned to the United States on April 27.

Laurean, 22, faces first-degree murder charges in the death of Lauterbach whose remains were found buried in a burn pit behind Laurean's home shortly after he fled Camp Lejeune, where the two worked together.

Justice has moved slow in this case but now this dirtbag will go to trial. He faces first-degree murder charges. After an international manhunt, he was arrested in Mexico. He was extradited only after prosecutors agreed not to seek the death penalty. This is one lucky guy because if anyone deserves the death penalty, he does.

More than two-and-a-half years after the charred remains of a Camp Lejeune Marine and her unborn child were found buried behind a Jacksonville house, the murder trial is set to begin for the former Marine charged in the case.

Cesar Laurean is charged with first-degree murder in the December 2007 death of Lance Cpl. Maria Lauterbach. He also faces charges of robbery with a dangerous weapon, financial transaction card theft, attempted financial transaction card fraud and obtaining property by false pretenses in connection of the theft of Lauterbach's bank card, which was later used to withdraw money from an ATM.

Pre-trial motions in the case were heard Monday morning, and jury selection is set to begin Tuesday.
