The start of Hans Reiser's trial was delayed yet again today. It appears to be a continuation of the conferences among defendant, defense attorneys, and judge from last week, where it appears to some that Reiser is out to fire his attorneys and delay the trial or defend himself, the same behavior he exhibited in his divorce case with the now disappeared Nina.

But it's no longer a divorce case. He's on trial for murder.

Apparent tensions between murder defendant Hans Reiser and his defense lawyers surfaced today but opening statement in his trial on charges that he killed his wife, Nina Reiser, last year remain set for Monday.

Alameda County Superior Court Judge Larry Goodman held a closed hearing with Reiser, a 43-year-old computer science engineer, and his attorneys, William DuBois and Richard Tamor, between 4 p.m. and 4:30 p.m. today, excluding prosecutor Paul Hora and reporters.

When he emerged from the hearing, DuBois said opening statements are still scheduled for Monday.

Reiser, his attorneys and Hora appeared grim, raising the possibility that Reiser was seeking to fire his lawyers on the eve of his trial.

At the end of the day, Reiser complained to DuBois that Hora "is showing my children's letters to witnesses."

DuBois explained that the prosecutor has a right to share evidence with the witnesses in the case, but Reiser continued to complain.

Finally, DuBois, appearing to be exasperated, told Reiser, "There's nothing to oppose."

During the lengthy divorce proceedings between Reiser and his wife, he fired several attorneys and represented himself at times.

OAKLAND, California -- The defense attorney for Hans Reiser -- the murder suspect and prominent Linux open source programmer -- said Monday he was "apprehensive" that his client wanted to testify on his own behalf.

Opening statements by prosecutor Paul Hora were postponed from Monday to Tuesday after a lengthy and private in-chambers conference between Hora, DuBois, the judge and Hans Reiser. Neither Hora nor DuBois would comment on that hearing.

Afterward, Reiser, DuBois and co-counsel Richard Tamor privately discussed their case at the defendant's table. Reiser's dark suit contrasted with his ghost-white skin as he peppered his attorneys with questions, read documents and took notes.

The prosecution's opening statements are attacking the young 6 year old son as a witness, saying he is too young and brainwashed by his father to be believable. They are going on his various statements before going to live wth his grandmother in Russia with his sister.

Given that is his missing mother's family, one would also have to consider carefully influences from that side of the family as well in the interim. There does seem to be some expectation he will return from Russia to testify.

The defense is also saying that Reiser removed the seat in his car to live in it because he was in bad financial straits, completely ignoring the fact that he removed it shortly after Nina disappeared and that he was living with his mother.

The suggestion would have to be that he was preparing to move out and live in his car, but he was quite at home with his mother. That is a very desperate excuse to explain removong his car seat, which probably is strapped to Nina in the Bay somewhere to weight her down.

I just find that hard to believe they would even say this. I felt like laughing. How totally ridiculous!!

This is pretty dramatic and very sad. Nina's little boy returned from Russia and testified today with the help of a Russian translator. The title of the NBC 11 news article says it all:

And his defense lawyer is outraged, goz. Says his grandmother is trying to influence his memory. The boy says he can't remember much about his mother after she brought him into Hans house for a parental visit.

Meanwhile Hans is trying to hand signal his son while he's testifying. The judge told him to stop trying to communicate with the witness.

Either the defense lawyer DuBois forgot to carry on the charade that they believe Nina is in Russia with her children or he's given up on it, but he didn't try to claim Nina was influencing the son's memory in Russia too.

But it's still a charade of a defense for this silent ex.

Wired is reporting that his mother put a lock on her steering wheel when his car disappeared and he started driving her car.

Holy cow.

So that's the only reason his car reappeared, sort of. He parked it several blocks away. The police found it by tailing him with undercover.

And minus the front passenger seat.

If we can find that seat, possibly in the Bay, we'll likely find Nina's body strapped to it.

Expect upcoming blockbuster testimony in Week four from Beverly Palmer, the defendant's mother. After Nina vanished, so did Hans Reiser's tiny Honda vehicle. He began using Palmer's car. She put a Club-style lock on her vehicle's steering wheel, and the defendant's vehicle reappeared.

When police discovered it, the front seat was missing. Inside, the police found the two books about murder and a sleeping-bag cover with Nina's blood on it.

The defense attorney, DuBois, said the seat was thrown in a dumpster, enabling the defendant to sleep in the Honda. The sleeping bag had the woman's DNA on it, he said, because she had slept in it.

Testimony resumes Monday.

This is pretty weird. An Olympics level judo coach who coached Reiser for ten years confronted Hans after Nina disappeared and asked him if he killed her.

But the judge did not allow the coach to testify what Hans replied to him as that was ruled to be hearsay and inadmissible.

I have to tell you I don't understand that at all. But I have a dim view of lawyers and the law so nothing new there.

For the purposes of finding Nina, this is some new information to me. Reiser was in Truckee the Sierra Nevada mountains three weeks after Nina disappeared.

On the other hand, it's on the major interstate route between San Fran and Reno, Nevada. There's no indication Reiser went on to Reno as in to gamble, just as far as Truckee as far as electronic transactions go.

It increases the real estate to search immensely.

If Hans was not gambling, I gotta wonder, what was he doing out there RD?

And, why the money transactions too, that I'm just curious about?

Will the search have to be expanded, was he dumping Nina's body? Why was our boy out there? This is getting interesting.

He was pulling a Scott Peterson, goz. He was driving around withdrawing money $1000 at a time and when the police closed in on him he had close to $10,000 and his passport in a backpack.

He pulled $500 at a time from an ATM in Truckee to get $1500, he was said to have gotten $1500 from three ATM transactions in Truckee.

Did he go drive into the wilderness until he found a place to hide Nina's body? I don't know. I guess we'll never know until if and when someone finds her remains someday.

I still think her body was dropped into water weighted down with that seat.

The prosecution is doing a good job in their attempt to convict Reiser of the murder of Nina.

The defense is basically you don't have a videotape of Hans murdering her.

Here's an excellent article by Karl Vick of the Washington Post on Du Bois' defense of Hans Reiser which Wired magazine has dubbed the Geek Defense.

There's also some new info on the connection with Sean Sturgeon, including that it's not clear whether Sturgeon's claim he killed eight people years ago is true.

If Nina alone had just taken up with him, then an association between his behavior and Nina could be made, but he was Hans' best friend, so it's just what passes for friends of the family in San Francisco, I guess.

Programmer's Attorneys Rely on 'Geek Defense'

OAKLAND, Calif. -- When Nina Reiser disappeared in September 2006, investigators suspecting foul play looked long and hard at her estranged husband, the computer genius Hans. Eccentric, awkward and notoriously difficult as a human being, Hans Reiser proved quite accommodating when it came to providing clues.

After taking no part in the massive public effort to search for the mother of his two children, he listed the reasons he was happy that Nina was gone in a phone call monitored by police. He had purchased copies of "Masterpieces of Murder" and "Homicide" from a local bookstore. Police discovered his passport in his fanny pack along with $8,000 in cash and a cellphone that could not be tracked electronically because its battery was removed, just like the phone found inside Nina's minivan, which was found abandoned on a side street smelling of rotting groceries; she had been to the store before dropping the kids at Hans's house.

Police also found soaked floorboards in his car and an empty space where the passenger seat should have been.

"Being too intelligent can be a sort of curse," defense counsel William Du Bois said. "All this weird conduct can be explained by him, but he's the only one who can do it. People who are commonly known as computer geeks are so into the field."

And so this week, after a prosecution case that took almost three months, Du Bois launched what Wired magazine dubbed "the Geek Defense." In court, Du Bois has taken pains to portray his client as an irritating nebbish. He has repeatedly asked Alameda County Circuit Court Judge Larry Goodman to order his client to stop distracting him by talking in his ear at the defense table. He called Reiser "an inconsiderate slob" in front of the jury.

"We're leaving the right message," Du Bois said outside court. "He's a very difficult person. It's very difficult to represent a genius."

After opening a company in Russia, he met Nina Sharanova, a striking obstetrician-gynecologist using a dating service to meet foreigners. They married when she became pregnant, but after the second child was born in 2001, Nina began an affair with Hans's best friend, Sean Sturgeon. The cross-dressing bondage and discipline enthusiast had been "maid of honor" at their wedding.

"His undergraduate thesis is on how if you change the perspective, the reality is different," said Ramon Reiser, the defendant's mathematician father, folding a pair of pants in the courtroom hallway as he waited to testify.

The thesis might apply to the evidence, which the judge in the preliminary hearing termed thin. Ramon Reiser argued that it's likelier that Nina is back in her native Russia with funds embezzled from her husband's business than in an unmarked grave she was carried to in the soaked, seatless Honda CR-X. The children are with Nina's mother in St. Petersburg.

"When you look at it, would Hans Reiser turn a hose on a car to wash it? Absolutely, his mother told him to get that car cleaned up," the elder Reiser said.

"I and my brother -- maybe it's genetic -- have driven our cars without the front seat. It's really convenient."

Yet not all the strangeness in the case arises from computers. Du Bois takes every opportunity to mention Sturgeon, who in addition to his role as Hans's friend and Nina's lover, told investigators that he killed eight people years ago. It's unclear whether the claim is true: Sturgeon remains free. But the judge forbade attorneys from mentioning the claim in court.

In any event, Sturgeon reportedly has insisted that whatever his crimes, he had nothing to do with Nina's disappearance. Wired quoted him as saying that, in the Reiser case, he is red herring, or rather, he said, "a red Sturgeon."

You forgot to mention the other guy, Sean Sturgeon, who was also close to the victim. The dude who has confessed to killing 8 (yes, eight) people, and was dating Nina (Hans' wife). IMHO, it's more likely that Hans was reading up on how to kill Sean (or even how to avoid being killed by Sean) than how to kill Nina.

A couple of clarifications. The books were bought after Nina disappeared, and the defense is that Reiser was researching police murder investigation tactics because he felt he was under investigation. (I don't know, doesn't this sort of belie the "he's so brilliant he doesn't know what going on around him" thing.)

The other is Sturgeon was close to the victim, but had also been Reiser's best friend. However, as part of a falling out that included Reiser suspecting him and Nina of having an affair, they exchanged some nastiness that went as far as lawsuits. The things that Reiser says in them about Sturgeon were the most bizarre up until Sturgeon claimed to have killed eight people in the past, so Sturgeon one upped hiom there.

As the WaPo article says today, it's unclear if the claim is true as Sturgeon still remains free. There's been no further mention of his claims anywhere.
